LIMA — A judge will review a video-recorded statement to determine whether the confession police said solved a 15-year-old murder case last year can remain in evidence.
At question is whether Lima Police Department detectives properly advised David W. Evans, 36, of his constitutional rights, commonly referred to as a Miranda warning. Detective Steve Stechschulte said Monday during a hearing on a motion to suppress the statements he did properly advise Evans during two interviews on Sept. 13 and Sept. 16.
Evans also was interviewed by a police detective in 2001 and Stechschulte said he is working on lining up the now-retired detective to come into court to talk about administering a Miranda warning at that time.
