76-year-old Sue Barnett, former deputy clerk in the Lima municipal clerk of courts office, is accused of stealing money from January 1997 to May 2012. Her defense counsel argued the delay in charges brought against her were not legal because they were filed outside the six year statute of limitations. The prosecution argued the statute of limitations applies when the alleged crime was discovered, which was 2016.
During testimony from current clerk of courts Jim Link, a $78,000 discrepancy was discovered when he took office in 2013, but he noted there was a constant amount of money that always seemed inconsistent between their books and what the banks reported for several years.
Judge Jeffrey Reed may have a ruling some time next week.
